In pursuance of the direction passed by this Court dated 28.8.2025, a report is submitted by the Additional District And Sessions Judge, Dinhata, Cooch Behar, which is forwarded by the learned District Judge, Cooch Behar. 4. The said report indicates that the convict-appellant Sayed Ali has already been deported to his native country Bangladesh on 05.3.2012 in connection with Sessions Case no. 79 of 2008 (Dinhata P.S. Case No. 120 120 of 2008 dated 25.5.2008). 5. In such above situation the instant appeal becomes infractuous. 6. Accordingly, the instant appeal being CRA 325 of 2009 be and the same is hereby dismissed, affirming the impugned judgement and order passed by the Trial Court dated 27.3.2009 and 30.3.2009 in connection with Sessions Case No. 79 of 2008 (S.T. No. 5(VI) 2008). 7. Thus, the instant appeal be and the same is dismissed on merit. 8. Let a copy of this order along with Trial Court Record be sent down to the Trial Court immediately. 9.
