1. The writ petitioner was appointed on November 19, 1991 by the Managing Committee of the respondent school as an Assistant Teacher, however, against a post not sanctioned on the said date. 2. Thereafter, by dint of the order of this Court, he has been granted approval with effect from May 18, 1999. The writ petitioner, being aggrieved that he has not been granted approval from the initial date of his appointment filed a writ petition before this Court earlier being W.P. No. 24668 (W) of 2015. The same was however withdrawn by him with the liberty to file afresh. 3. Hence, the present writ petition has been filed, seeking relief that service of the petitioner be approved with effect from March 15, 1997, that is the date on which one post in the said school was vacant due to death of a permanent approved teacher. 4. None appears on behalf of the respondents. 5. The Court finds it proper to dispose of the present writ petition by directing the respondent no. 2 to consider the prayer of the petitioner that he may be approved with effect from March 15, 1997, instead of
2 May 18, 1999 as on March 15, 1997, one of the permanent sanctioned post was vacant due to death of the Assistant Teacher employed as against the same. 6. Let the respondent no. 2 afford opportunity of hearing to the petitioner in this regard and consider his documents. 7. Let a reasoned order be passed by the said authority, in case of the prayer of the petitioner for grant of approval with effect from March 15, 1997 is rejected. 8. Let the exercise as above be concluded within a period of six weeks from the date of communication of copy of this order. 9. Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents. 10. With the above observations and directions, the writ petition being WPA 8574 of 2016 is disposed of, along with the pending applications, if any. 11.
