ORDER: The instant petition under Section 528 of BNSS., has been filed by the Petitioner/Accused, seeking quashment of the proceedings pending against him in C.C.No.881 of 2022 on the file of the learned XII Additional Metropolitan Magistrate at Anakapalli, for the offence punishable under Section 324 of I.P.C. Heard Sri B.K.Chakravarthy, learned counsel for the petitioner/Accused
2. and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.
Learned counsel for the petitioner would submit that because of the civil
3. dispute, a false case has been lodged against the petitioner. Learned counsel for the petitioner would further submit that the petition may be disposed of without causing any prejudice to the rights and contentions of the petitioner, by dispensing the presence of the petitioner/Accused before the Trial Court.
4. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders.
5. Considering the submissions made and a keen perusal of the material placed on record, it is a case of 324 of I PC. It is alleged in the complaint and also charge sheet that victim was beat by a stone over his head and he suffered simple injuries. Thereby a case has been lodged. After due
investigation, the Police filed charge sheet, cognizance for the offence under Section 324 of IPC that view, it is not a fit the petitioner and also the background The Court has also taken against the petitioner. In case of quashment. However, considering the age of of the case, the presence of the petitioner before the Trial Court is dispensed with unless his presence is specifically directed by the Trial Court.
6. In the result, the Criminal petition is disposed of. As a sequel thereto, miscellaneous petitions pending, if any, shall stand SD/- K.J.RAJA BABU ASSISTANT REGISTRAR ^SECTION OFFICER closed.
