JUSTICE LALITHA KANNEGANTI ORAL ORDER The present Writ Petition is filed questioning the order passed on I.A.No.6 in G & W.C. No.226/2022 dated 25.04.2024 by the Court of II Additional Principal Judge, Family Court at Bengaluru, whereby the Trial Court had granted the visitation rights on 1st and 3rd Saturday of every month between 11:00 a.m. to 1:00 p.m. in any public place near the residence of the respondent - mother with prior intimation to her and he is not permitted to take the daughter outside Bangalore and he is entitled to visit his daughter on her birthday from 4:00 p.m. to 7:00 p.m. in any public place near the residence of the mother. The mother is directed to co-operate and facilitate the father to exercise the visitation. Both the parties are directed to exchange their recent mobile numbers for communication and the father to take all safety measures when the child is with the father and both the parties were directed to maintain harmony and behave like responsible parents at the time of exercising the visitation rights. - 3 - NC: 2025:KHC:14633 WP No. 12847 of 2024 2. This Court on several occasions had interacted both the parents and the daughter and right from 15.07.2024 till 07.02.2025, several orders were passed by this Court and the father had exercised the visitation rights. Today they have come up with a memorandum of settlement before this Court signed by both the parties and their respective advocates and they have agreed that the custody of the child would be with the mother and the father will have the visitation and they have agreed upon how the visitation has to go on and also about the holidays and all other aspects and the husband has agreed to pay an amount of Rs.73,50,000/- and out of that, an amount of Rs.20,00,000/- is handed over to the mother today by way of Demand Draft No.011624 dated 31.03.2025 drawn on Axis Bank and the remaining amount will be paid to the mother within a period of three months from the date of signing of this settlement memo or on final disposal of the mutual consent petition whichever is earlier. It is stated that they will be filing mutual consent divorce petition within a period of 10 days from today. In the light of the settlement arrived at between the parties, this Court is passing the following: - 4 - NC: 2025:KHC:14633 WP No. 12847 of 2024 ORDER i) The Writ Petition is disposed of in terms of the memorandum of settlement dated 02.04.2025. ii) The Registry shall annex the Memorandum of Settlement Agreement along with the order.
