1. Heard the learned counsel for the applicant.
2. This is an application praying for stay of the impugned
Judgment and Award dated 21.11.2019, passed by the learned Addl. Dist. & Sessions Judge (FT) Court, Hojai in MAC Case No.569/2016.
3. The learned counsel for the applicant submits that the applicant has already filed an appeal before this Court, challenging the legality and validity of the impugned judgment and award dated 21.11.2019, passed by the Addl. Dist. & Sessions Judge, (FT) Court, Hojai in MAC case No.569/2016 and it is submitted that there are good grounds taken by the applicant and the appeal is likely to succeed and therefore, it no interim
Page No.# 3/3 protection is granted to the appellant it will cause irreparable loss and prejudice.
4. It is therefore prayed that the impugned judgment and award dated 21.11.2019, passed in MAC case No.569/2016, may remain stayed during the pendency of the connected appeal.
5. The court has considered the submissions of the applicants and is of the view that the judgment and award dated 21.11.2019 passed in MAC case No.569/2016, may be stayed during the proceeding of the connected appeal subject to the condition that the applicants shall deposit 30% of the awarded amount before the Registry within a period of four weeks from today.
6. With the above, the I.A stands disposed of.
