1. Heard Mr. R. Hoque, learned counsel for the petitioner and also heard Mr. D. P. Goswami, learned Addl. P.P for the State.
2. This application has been filed under Section 483 BNSS, seeking bail of the petitioner, namely, Hussain Ali, who was arrested on 24.08.2025 in connection with Sessions (P) Case No. 128(DM)/2025 arising out of Mangaldai P.S.
Page No.# 2/2 case No. 164/2025 (GR No. 646/2025) u/s 96 of BNS,2023.
3. The allegation against the petitioner has reflected in the FIR is that the petitioner kidnapped the niece of the informant who was aged about 15 years 5 months during her leisure period at school. The case has already been charged- sheeted and charges have been framed where the petitioner pleaded not guilty. It appears that the victim was recovered the very next day. It is reflected in the charge-sheet that the victim girl stated that the accused did not sexually assault her which is also supported by the result of the medical examination which is also reflected in the charge-sheet and in the meantime the petitioner has spent 79 days behind the bars.
4. Having regard to the above facts and circumstances on the record the prayer for bail is allowed.

Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.50,000/- (Rupees Fifty Thousand) with one surety of like amount to the satisfaction of learned Sessions Judge, Darrang, Mangaldai in connection with the aforesaid case subject to the following conditions:- (a) That the accused person shall be available for remaining trial; (b) That the accused persons shall not hamper or tamper with evidence.
6. Accordingly, the bail petition is disposed of.
