BEFORE HONOURABLE MR. JUSTICE NELSON SAILO ORDER Date : 19.11.2025
Heard Mr. S. Hoque, learned counsel for the petitioner. Also heard Mr. K. K. Dey, learned counsel for the respondent No.1 and Mr. D. Deka, learned counsel for the respondent No.6. Page No.# 3/3 [2.] By filing this writ petition, the petitioner has projected her grievance which is to the effect that the appeal filed by her before the State Chief Information Commissioner, Assam in the month of February and May has not been considered and disposed of till date. [3.] Mr. D. Deka, learned counsel for the respondent No.6 on instructions submits that there is no specific time frame prescribed for considering and disposing of a second appeal under the Right to Information Act, 2005. The Commission at the present is considering the appeals filed in the year 2024 and that the appeal of the petitioner can only be considered as per its own turn. He however submits that if a direction is given by this Court, the respondent authority would definitely comply with the same.
[4.] Considering the above submission and without expressing anything on merit, the writ petition is disposed of by directing the Second Appellate Authority to consider the appeal filed by the petitioner in the month of February and May, 2025 as expeditiously as possible and preferably within a period of 2(two) months from the date of receipt of a certified copy of this order. [5.] With the above direction, the writ petition stands disposed of. JUDGE Comparing Assistant
