Page No.# 2/3 pre arrest bail to the accused/petitioner, namely, Minuwara Khatun @ Miniara Akhtar, who is apprehending arrest in connection with the Sarthebari P.S. Case No. 71/2025, registered under Sections 103(1)/3(5) of the BNS, 2023. 3. One Sarbesh Ali lodged a FIR before the Balapara Out Post alleging inter alia that on 28.05.2025 at about 12 O'clock at night, the daughter-in-law of the informant namely Minuwara Khatun inform him that the condition of his son Ruhul Amin is very serious. Immediately the informant went there and noticed that his son Ruhul Amin is died. On asking the accused No.1 informed the informant that his son died in by hanging. On receipt of the said ejahar, Balapara O.P. DGE dated 01.06.2025 and forwarded the same to the Sarthebari P.S. for registering a case under proper Section of law and accordingly Sarthebari P.S Case No. 71/2025, U/S-103(1)/3(5) BNS has been registered. 4. The leaned Addl. P.P. submits that since the charge-sheet has been submitted vide C.S. No. 110/2025 dated 28.08.2025. The petitioner may be asked to face the trial and it appears from the record that some incriminating material against the accused/petitioner, but there is no mention about any quarrel on the date of the incident when the deceased committed suicide. 5. The postmortem report also reveals suicidal hanging and no other injuries are found upon the deceased. 6. Pursuant to the interim protection granted by this Court, the petitioner appeared before the I.O. and her statement was recorded. 7. Considering the above and the fact that the investigation is already over, there appears to be no necessity of taking the petitioner in custody. Page No.# 3/3

Accordingly the interim pre-arrest bail granted vide order dated 13.08.2025 is hereby made absolute, subject to the condition that petitioner shall face the trial regularly, if one commences. 10.
