2. The case of the prosecution, jn a nutshe[], js thaton 27.06.2025 at4.15 p.m., on recejp{ of credible information about illegal possessI'On and transportat]'on of ganja, the sub Inspector of police, secured the presence of hI'S Staff and medI-atOrS and rLIShed to Got]am village Bye-Pass Road Junc{jon, Got[am village and found three persons in suspjcl|ous cllrcumstances. on seeing police, they trI|ed to escape. Then the poll'ce apprehended them and on enquiry, they disclosed their I'dentity particulars as that of Al to A3 and po]I|Ce found 1.2 kgs of ganja l'n theI'r POSSeSSjOn. Then the police arrested the accused, set-Zed the contraband and other material and sent the accused to court fo.r judicial remand. They confessed the I'nVOIvement of other accused in the commissI-On Of the offence. \\ \>
3. Heard the learned counsel for the petI'tjOner and the learned Assjs{ant publl|c prosecutor for the respondent/state. perused the mater['al on record. 4. SrI- B.Rama Shankar Rao, the learned counsel for the petl-tjoner, subm['ts that based on the confessl'on statements of A1, the petI'tl'Oner/A4 was impII-Cated l[n this case and was arrested on 28.06.2025. Since then, he has been in judjcl'al custody. The FIR was lodged on 27.06.2025[ The learned single Judge of thl's court granted bail to accused Nos.1 to 3 jn Criminal Petition No.6638 of 2025, dated o9.07.2025. 5. Perconfra, Ms. P. Akila Naidu, the learned Assl-slant public prosecutor, opposed in granting of ba" stating that the investigation is not completed; I-f the petitioner is enlarged on bail, he would not be available for the investigation i.-`. 4`}> \\ ( \>
and he would escape from the clutches of law; and urged to dismiss the bail petition. 6. The petitioner was arrayed as an accused No.4in this case based on the confession given by Accused No.1. Accused No.1 was found in possession of 1.2 kgs of ganja, which does not constitute a commercial quantity.
The allegation of the prosecution is that the petitioner is the cultivator of the ganja. The petitioner was arrested on 28.06.202.5 and has been in judicial custody for the past 27 days. \_ a *EE
7. The learned Assistant Public Prosecutor submits that there is no other ¢`````t adverse antecedents against to the petitioner. l_
8. The learned Single Judge of this Court, by order dated 09.07.2025 in Crl.P.No.6638 of 2025, enlarged Accused Nos.1 to 3 on regular bail. 9. Considering the nature and gravity of the allegations made against the petitioner, his alleged role in the case, and the period of detention already undergone by h-lm, this court is inclined to enlarge the petitioner on bail. 10. ln the result, the criminal petition is a[]owed with the following strihgent conditions: i. The petitioner/Accused No.4 herein shall be released on bail on his executing a personal bond for Rs.10,000/-(Rupees ten thousand only) with two (o2) sureties for a like sum each to
