The applicant, who is in custody since 05.03.2025 has approached this Court for grant of regular bail in connection with Markacho P.S. Case No.99 of 2024, corresponding to G.R. No.235 of 2025, for the offence under Section 303(2) of B.N.S., 2023 and further cognizance has been taken under Sections 303(2), 317(2), 317(5) and 3(5) of B.N.S., 2023, pending in the court of learned J.M.1st Class, Koderma. 2. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 3. Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by learned counsel for the applicant that the recovery of stolen motorcycle is from the forest area not from the conscious possession of this applicant. On above basis prayer for bail has been made. 4. Learned A.P.P. has opposed the prayer for bail of the applicant. 5. Considering the period of custody, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned J.M.1st Class, Koderma in connection with Markacho P.S. Case No.99 of 2024, corresponding to G.R. No.235 of 2025, subject to condition that one of the bailors will be the father of this applicant. Further, the applicant will submit self-attested copy of his Aadhaar Card and also give his mobile number before the learned trial court which he will not change during pendency of this case without prior permission of the court.
