30.06.2025 Court No.28 Item No.33 ssi CRM (A) 1739 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Gangarampur PS Case No.83 of 2024 dated 27.02.2024 under Sections 21 (c)/22 (c)/23 (c)/27A/28/29 of the NDPS. And In the matter of: Noor Islam @ Nur Islam & another. ….Applicants/Petitioners. Mr. Kaushik Choudhury ….for the petitioners Ms. Sreyashee Biswas Ms. Rajnandini Das ..for the State Learned counsel appearing on behalf of the petitioners submits that the petitioner no.2 has already been arrested. As such, the application has become infractuous, so far as the petitioner no.2 is concerned. Accordingly, the application for anticipatory bail is dismissed as having become infractuous, so far as the petitioner no.2 is concerned. Learned counsel appearing on behalf of the petitioner no.1 submits that he has been falsely implicated in this case pursuant to the statement of the co-accused, which is inadmissible in evidence. Charge sheet has already been submitted. The principal accused was granted anticipatory bail. Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the State relies on the case diary and submits as follows. Apart from statement of co- accused, there are call records details showing calls made between the petitioners and the other co-accused. That apart, a 2 proclamation has already been issued against the present petitioner. Considering the incriminating materials available against the present petitioner and the fact that a proclamation has already been issued, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail to the petitioners is rejected. (Jay Sengupta, J.)
