JUSTICE A.GUNESHWAR SHARMA 5.11.2025 Heard Mr.Th.Mahira, learned counsel for the petitioner and Mr.P.Ibomcha Singh, learned counsel for the respondents. By the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner is praying for quashing the impugned order dated 20.01.2025 passed by the learned Family Court, Manipur in Cril (Execution) No.10 of 2029 with reference to Cril (M) Case No.10 of 2018 and Mat.(Divorce) Suit No.205 of 2015. By the impugned order, the petitioner who is judgment debtor before the Family Court, could not appear on 20.01.2025 and hence, non-bailable warrant was issued. Vide order dated 11.2.2025, this Court issued notice and stayed the order dated 20.1.2025 subject to deposit of a sum of Rs.30,000/- before the Family Court. Mr.P.Ibomcha, learned counsel for the respondents submits that the respondent has received the sum of Rs.30,000/- as directed by this Court. During course of hearing, both parties submit that the matter may be disposed of as the petitioner has appeared before the Family Court and the purpose of issuing non-bailable warrant does not survive. Recording the submissions made at the Bar and in the peculiar situation, the present petition is closed as the legality of the non-bailable warrant does not survive upon the petitioner before the Family Court.
