The petitioner has been made accused in connection with Chouparan P.S. Case No.113 of 2024, for the offences registered under Sections 414/34 of the Indian Penal Code, Sections 17(C), 18(C), 20(b)(ii)(c) of the N.D.P.S. Act and Section 33 of the Indian Forest Act, pending in the court of learned Sessions Judge-cum-Special, Judge, N.D.P.S., Hazaribag. On 13.05.2024, the petitioner along with co-accused persons were apprehended and 39 Kgs. Doda and 2.9 Kg. of opium were recovered from their possession. Report earlier called for, from the learned Additional Sessions Judge- VIII, Hazaribag whether the samples collected in accordance with the provisions of Section 52-A(4) of the N.D.P.S. Act., has been received. It appears that learned Additional Sessions Judge-VIII, Hazaribag has reported that the samples were not collected in accordance with the provisions of Section 52-A(4) of the N.D.P.S. Act. In view of the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge-cum-Special, Judge, N.D.P.S., Hazaribag, in connection with Chouparan P.S.
