The case of the prosecution js that the defacto complainant and the accused were engaged in real estate business and in the course of their business transactions, accused cheated the defacto complainan{ and misappropriated the amounts. on 17.05.2025 at about o6.00 PM., when the complajnant went to the house of Accused No.1 and requested him for amount, Accused Nos.1 and 2 kicked him on his chest, due {o whl-ch he fell on the ground[ Basing on the report of the complainant, a case was registered against the petitI'OnerS/accused. 3. Sri Habibulla Shaik, learned counsel for the petitioners submits that the petitioners have not committed any offence,- they were falsely implicated Ion this Case,I they are ready to abide any conditions to be I'mPOSed by thl-s Court; and urged to grant pre-arrest ba" to the petitioners. 4. Per confra, Ms. P.Akhila NaI-du, the learned Assistant public prosecutor, opposed in granting of ba" stating that investigation I-s not yet completed; I'f the petitioners were granted pre-arrest baj], they would repeat the same offence and urged to dl'smI-SS the bail petition. 5. The alleged inc'lden{ Of beating the defaCtO COmPla-lnant by Accused No.1 and the Petitioner No.1 occurred on 17.05.2025 at about o6.00 PM, whereas the typed written report Was lodged by the defaCtO complainant on 19.05.2025. As much, there was a delay Of two (02) _'_..--_.--_-`--- days in lodging the compla-lnt which Was not COnV'lnCingly explained. 7. ln view of the nature Of the allegations levelled against the petitioners, the alleged role played by the Petitioners in this Case and the civil disputes pending in between the petitioners and the defacto -\ --' ` complainant, this court deems it fit to grant pre arrest bail to the petitioners/accused. 8. ln the result, the Criminal Petition is allowed With the following conditions: i. ln the event of their arrest, the petitioners/Accused shall be enlarged on bail subject to their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, With two Sureties for the like Sum each to the satisfaction of the arresting police officials; ii.
