Heard learned counsels for the parties. 2. The instant bail application has been preferred by the petitioner for grant of regular bail for the offences registered under Section 309 (4) of Bharatiya Nyaya Sanhita, 2023 and charge has been framed under Section 310(2) of B.N.S. in connection with Rajnagar P.S. Case No. 65/2024 corresponding to G.R. Case No.328/2025 (S.T. Case No.117/2025) M.C.R.A. No.908/2025. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and he has committed no offence as alleged in the F.I.R. He further submits that the charge has been framed on 17.07.2025 and out of seven charge- sheeted witnesses none of them has been examined till date and the petitioner for no offence has been languishing in custody since 27.03.2025; as such, the petitioner may be enlarged on bail. He submits that the petitioner is ready to abide by every condition as imposed by this court. 4. Learned A.P.P. opposes the prayer for bail of the petitioner. 5. Having regard to the facts of the case and looking to the allegations made against this petitioner coupled with the fact that out of seven charge-sheeted witnesses, no witness has been examined as such there is no likelihood of early conclusion of trial and the petitioner is in custody since 27.03.2025; therefore, I am inclined to enlarge this petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, II Seraikella in connection with Rajnagar P.S. It is made clear that the petitioner shall appear on each and every date before the learned trial court and he shall not threaten any witnesses and shall co- operate in trial and if any adverse report will come against this petitioner, learned trial court shall be at liberty to cancel the bail of this petitioner.
