BEFORE HONOURABLE MR. JUSTICE ANJAN MONI KALITA ORDER 19.12.2025 Heard Mr. N. K. Das, learned counsel appearing for the accused/applicant. Also heard Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State. Page No.# 2/3 This is an application under Section 483 of the BNSS, 2023 praying for granting bail to the accused/applicant in connection P.R. Case No.129/2025 pending in the Court of learned Additional Chief Judicial Magistrate, Bongaigaon, arising out of Manikpur P.S. Case No.39/2025 registered under Sections 3(5)/303(2) of the BNS and added Sections 305(B)/305(C)/306/317(2)/317(4)/112/61(2) of the BNS, 2023. The gist of the allegation made in the F.I.R. dated 16.03.2025 is that the alleged accused/applicant was involved in unloading boxes of fishes from a truck. For carrying out the unloading, the alleged accused/applicant was paid by the driver and the helper of the truck. On receipt of the F.I.R., Manikpur P.S. Case No.39/2025 was registered against the accused/applicant under the aforementioned sections. The learned counsel for the accused/applicant submits that the accused/applicant was arrested on 23.03.2025 and for the last 268 days he is behind the bars. The learned counsel submits that 5 co-accused alleged to be involved in connection with the aforesaid police case have already been granted bail. The learned counsel for the accused/applicant submits that looking into the alleged offence as well as his long detention in jail, the accused/applicant should be allowed the privilege of bail at this stage. Taking into account the whole facts of the case as well as his long
Page No.# 3/3 detention in the instant case, this Court is of the considered opinion that the accused/applicant should be allowed the privilege of bail.
Accordingly, it is directed that that the accused/applicant shall be released forthwith on bail on furnishing a bail bond of Rs.20,000/- with a surety of like nature to the satisfaction of the learned Additional Chief Judicial Magistrate, Bongaigaon, subject to the following conditions :- (1) That the accused/applicant shall appear shall appear before the I.O. as and when called for. (2) That the accused/applicant shall not hamper or tamper with the investigation. (3) That the accused/applicant shall not commit any offence while on bail.
