This is an application under Section 483 of BNSS, 2023 praying for release of the petitioner namely, Abhimanyu Das @ Abhimanya Das, on bail in connection with Sonapur P.S. Case No.
Page No.# 2/2 139/2025 under Sections 303(2)/317(1)/318(4)/61(2) BNS. The allegation made against the present petitioner is that he had taken six dumpers on hire, bearing registration numbers ML-10D-0875, ML-10D-0698 ML-10D-0874 ML-10D-0876 ML-10D- 0872 and ML- 01AH-5756. These vehicles were engaged in transporting boulders from Bhutan for export to Bangladesh. The vehicles entered the Land Customs Station at Halisor on 16.07.2024, 17.07.2024 and 19.07.2024, but failed to report at the customs exist pint in Dalu, Meghalaya,. Subsequently, the vehicles were found missing from a Leyland Service Centre near Kalyanpur, leading to the registration of the present case. It appears that the petitioner was arrested on 20.08.2025 in connection with another P.S case, in which charge-sheet has already been submitted. Subsequently he has been shown arrested in the present case on 06.09.2025. Having regard to the allegation made in the FIR, the matter appears to be primary of civil nature. In the earlier case, the petitioner was granted bail by the learned Additional Sessions Judge, Goalpara vide order dated 04.09.2025 in BA No. 433/2025. Having regard to the length of detention as well as the nature of the allegations, the prayer for bail is allowed. The petitioner named above is allowed to go on bail on furnishing a bail bond of Rs.50,000/- (Rupees fifty thousand) with a surety of the like amount to the satisfaction of Elaka Magistrate in connection with the aforesaid case. Bail application stands disposed of. JUDGE Comparing Assistant
