1. The grievance ventilated through this petition is on account of non-
consideration of petitioner's case for promotion on the next higher post of Teacher (Panchayat).
2. Learned counsel for the petitioner would submit that the petitioner is in public employment with avenue of promotion provided under the Government recruitment rules known as Chhattisgarh Teacher (Panchayat) Cadre (Recruitment and Conditions of Service) Rules,
2012. It is submitted that the petitioner has completed minimum REKHA SINGH
-2- eligibility of 7 years and large number of posts of Teacher (Panchayat) are lying vacant. The petitioner enjoys a very high position in the seniority list and is therefore within the zone of consideration. It is further submitted that the petitioner made a representation pursuant to
order dated 08.08.2016 passed in WPS No.3495 of 2016 and it was decided by the Chief Executive Officer, Zila Panchayat Bilaspur on 28.02.2017, wherein, it has been observed that the name of the petitioner in the gradation list was at Serial No.3782 and the petitioner joined services on 05.08.2005. It is also observed that the claim of the petitioner for promotion would be considered forthcoming year. He would contend that till date, no decision has been taken.
3. On the other hand, learned counsel appearing for the respondents would oppose.
4. Heard the learned counsel appearing for the parties and perused the documents placed on record.
5. Taking into consideration the submissions made by Mr. Rajput, particularly that Maths teachers appointed on 17.07.2006 have already been promoted, whereas, the petitioner was appointed on 08.05.2005, the Chief Executive Officer, Zila Panchayat, Bilaspur is directed to consider the claim of the petitioner for promotion strictly in accordance with law preferably within a period of 60 days from today.
6. With the aforesaid observation(s)/direction(s), the present petition is
