1. Heard Mr. S. Das, learned counsel appearing for the accused petitioner as
Page No.# 2/3 well as Mr. B. Sarma, learned Addl. P.P., Assam appearing for the State respondent and Mr. D. Gogoi, learned Amicus Curiae appearing for respondent No.2. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Kuddush Ali @ Md. Kuddus Ali @ Bagha, praying for grant of bail in connection with Special POCSO Case No.225(N)/2025 arising out of Rupahihat PS Case No. 195/2025 under Sections 6/8/12/18 of POCSO Act. 3. The scanned copy of the TCR has already been received. 4. The accused was arrested on 15.06.2025 and since then he is in detention. 5. Learned counsel for the petitioner submits that as part of the trial the informant and the victim have already been examined and in support of the contention submits certified copies of their depositions and I have perused the same. 6. Learned Additional Public Prosecutor submits that trial is not yet complete, though there is no dispute that the informant and the victim have been examined. 7. Mr. Gogoi, learned Amicus Curiae also submits that necessary orders may be passed as per law and he does not dispute the examination of the victim and the informant. Considering the progress of investigation and the length of under trial detention- I deem it fit to grant bail to the accused at this stage. 8. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.25,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall co-operate with the remaining trial.
Page No.# 3/3 (b) Shall not hamper or tamper with the evidence. (c) shall not intimate or harass or cause any harm to the victim and her family members . 9. Violation of any of the bail conditions shall entail cancellation of bail. 10. Accordingly, this bail application stands allowed and disposed of. JUDGE Comparing Assistant
