Neutral Citation No. - 2025:AHC:29249 Court No. - 5 Case :- WRIT - A No. - 2615 of 2025 Petitioner :- Meera Respondent :- State Of Up And 4 Others Counsel for Petitioner :- Vijendra Kumar Mishra Counsel for Respondent :- C.S.C.,Nagendra Nath Mishra Hon'ble Ajay Bhanot,J. Heard Shri Vijendra Kumar Mishra, learned counsel for the petitioner, Shri Nagendra Nath Mishra, learned counsel for the respondents and learned Standing Counsel for the State. The petitioner prays for releasing post-retiral benefits (gratuity and pension) of his father considering ad-hoc services as qualified service for computing the gratuity and pension. He has also made several representations in this regard but to no avail. Learned counsel for the respondents and learned Standing Counsel for the State submit that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, they fairly contend that the claims regarding post-retiral benefits are liable to be decided by the competent authority in a reasonable time frame. In light of the submissions made at the Bar and without going into the merits of the case, the respondent authorities are directed to decide the representation of the petitioner for releasing post-retiral benefits (gratuity and pension) of his father considering ad-hoc services as qualified service for computing the gratuity and pension as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 3.3.2025 Mohini Digitally signed by :- MOHINI RAI High Court of Judicature at Allahabad
