m 2 V-- Dr. YLR, J Crl.P.No.7152of 2025 Dated 15.07.2025 ’I the petitioner/Accused for granting of pre-arrest bail in connection with Crime No.69 of 2025 on the file of Varikunta Padu Police Station, SPSR Nellore District, registered for the alleged offences punishable under Sections75(1), 351(2) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’) and Section 10 read with 9 (f) of the Protection of Children from Sexual Offences Act, 2012 (for brevity ‘the POCSO Act’). 2. The case of the prosecution is that on 01.07.2025 at 10:00 AM, at MPUP School, Thurpu Boyamadugula Village, VK Padu Mandal, the complainant, mother of an 11-year-old victim girl studying in the 6^^ class at the school, reported to the Police Station that her daughter was sexually assaulted by the accused, a school teacher at the same institution. It is alleged the accused touched the minor girl's cheeks and put his hands inside her frock with the intent to satisfy his sexual desire. Upon learning of this, the victim's mother and fellow school committee members rushed to the school and confronted the accused about his indecent behavior. However, the accused allegedly abused them with filthy language, insulted their modesty with abusive words, took an iron rod, and threatened them. During this confrontation, the school headmaster intervened, and the accused attempted to throw stones at

Sri.Gundala Siva Prasada Reddy, the learned counsel for the petitioner, submits that the petitioner has not committed any offence; he is aged about 52 years; he is sole breadwinner of his family; he was falsely implicated in this case and urged to grant pre-arrest bail to the

Per contra, Mr. Neelotphal Ganji, the learned Assistant Public Prosecutor, opposed in granting of pre-arrest bail stating that investigation is not yet completed; if the petitioner was granted pre-arrest bail, he will repeat the same offence and urged to dismiss the bail application. 5.
