1. Heard Mr. M Dutta, learned counsel for the petitioner. Also heard Mr. R J Baruah, learned Additional Public Prosecutor for the State. 2. This is an application under 483 of the BNSS, 2023 praying for granting bail to the petitioner, namely Rina Begum Barbhuiya alias Rina Begum
Page No.# 2/3 Barbhuiya, in connection with Dholai P.S Case No. 111/2025 under Section 31(2)/103(1) of the BNS, 2023. 3. The allegation is that one Nagib Hussain Barbhuiya lodged an FIR at about 2:30 P.M before the Officer-in-Charge, Dholai Police Station, alleging inter alia that accused No. 1, namely Smti. Rina Begum Barbhuiya (wife of the deceased Imran Hussain), and accused No. 2, Basiruzzaman Laskar (driver of the deceased), were involved in an illicit relationship and had conspired to kill the deceased by administering poison. It was also alleged that the said accused persons misappropriated an amount of Rs. 20,00,000/- from the deceased’s house. 4. CD as call for has been received. 5. It is submitted by the learned counsel for the petitioner that the accused persons have spent 89 days behind bars and since the charge-sheet has not been submitted as yet, and having regard to the length of detention, the prayer for bail may be allowed. 6. Per contra, Mr. R J Baruah, learned Additional Public Prosecutor submits that as of today, the petitioners are not entitled to default bail and moreover, there is sufficient incriminating material against the petitioners in the CD and the nature of the allegations is extremely grave, where the petitioner is alleged to have a conspired with the co-accused and killed her own husband. 8. Upon perusal of the CD, there appears to be sufficient incriminating
Page No.# 3/3 material attributing the direct role of the petitioner in causing the death of her husband in conspiracy with the co-accused. 9.
