"(1) Issue, a writ, order or direction in the nature of mandamus directing the respondent authorities to re-construct and repair the illegally demolished boundary wall of the goons of the locality and to ensure the safety of the employees, doctors, equipments and assess of common citizens to the PHC Center, Primary Health Centre Uchagaon, Bulandshahr. Issue, any other writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case. (4) Award cost of the petition to the petitioner."
2. It is sought to be projected in the writ petition that the construction sought to be undertaken by the respondents was at the instance of certain anti-social elements and was not in the interest of Primary Health Centre, Uchagaon, Bulandshahr. 3. Detailed instructions have been produced by the respondents, which are duly signed by the Chief Medical Officer, Bulandshahr, Sub Divisional Officer, Syana, Medical Superintendent, Community Health Centre, Uchagaon, Bulandshahr and Block Development Officer, Uchagaon, Bulandshahr, indicating the
requirement of construction and making serious allegations against the conduct of the petitioner. 4. Response to the said instructions have been filed inter alia questioning the same and reiterating the allegations. Further affidavit has been filed seeking to allege that the construction is being undertaken by encroaching the land of the Irrigation Department. 5.
Having gone through the averments made in the petition, seeking to allege the construction at the instance of anti-social elements and the instructions produced by the respondents duly signed by practically all the concerned authorities of the area and the fact that the tender for the construction has been issued by the Block Development Officer, Uchagaon, Bulandshahr, we do not find any public interest involved in the petition whereby the petitioner is seeking to allege that the construction is against the interest of the Health Centre whereas all other authorities feel that the same is in the interest of the Health Centre. 6. Consequently, the petition is dismissed.
