PUBLIC PROSECUTOR 2 The Court made the following: ORDER: The Criminal Petition has been filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioner/Accused No.4 on bail in Cr.No.81 of 2024 of Paderu Police Station, Alluri Sitharama Raju District, registered against the petitioner / Accused No.4 for the offence punishable under Section 20(b)(ii)(B) r/w 8(c) of the of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. The case of the prosecution is that on 23.05.2024 at 17.05 hours, on receipt of credible information, Sub-Inspector of Police, Paderu Police Station, along with his staff and mediators, while conducting vehicle checking at Vanthadapalli Check Post, police caught hold of A1 to A3, while A4 and A5 absconding from the scene, and seized 13.030 kgs of ganja under the cover of mediators report and registered a case. 3. Sri P.M.Mithileswara Reddy, learned counsel for the petitioner, submits that the petitioner has not committed any offence; he was falsely implicated in this case; he is sole breadwinner of his family; he is ready to abide any conditions to be imposed by this Court; and urged to enlarge the petitioner on bail. 3 4. Per contra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor, submits that there are no adverse antecedents against the petitioner. 5. Perused the record. 6. It is allegation of the prosecution that the petitioner and others were found in possession of 13.5 kgs of ganja. The seized ganja is not a commercial quantity. The petitioner himself surrendered before the police on 07.05.2025 and ever since, he has been in judicial custody. For the past 71 days, he is in judicial custody. There are no adverse antecedents against the petitioner. Investigation is not yet concluded and charge sheet is not filed so far. 7. Considering the nature of the allegations levelled against the petitioner, the alleged role played in this case, the period of detention undergone by the petitioner and the fact that he himself surrendered before the police, this Court deems it fit to enlarge the petitioner on bail. 8. In the result, the Criminal Petition is allowed with the following conditions: i. The petitioner/Accused No.4 shall be enlarged on bail subject to executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate, Paderu. 4 ii. On release, the petitioner / Accused No.4 shall appear before the Station House Officer concerned, on every Sunday in between 10:00 am and 05:00 pm, for a period of three (03) months or till filing of the charge sheet. iii. The petitioner / Accused No.4 shall not tamper or hamper the evidence and shall cooperate with the investigating officer in further investigation of the case and shall be available to the investigating officer as and when called by him. ________________________ DR.
