1. Heard Mr. S. Sarma, learned counsel appearing for the accused petitioners as well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused- petitioners, namely, Nasir Uddin and Jesim Ali @ Josim Ali , praying for grant of bail in connection with Pathsala P.S. Case No.94/2025 under Sections 3(5)/118(2)/109(1) / 126(2)/131/302 of the BNS Act (corresponding to GR No. 298/25). 3. Case diary as called for is received. 4. The gist of allegation is that on 01.11.2025 at night the informant was beaten by a dog whereupon he went to the hospital along with his friend/neighbor, Dipankar Talukdar for taking vaccination and when they reached the hospital some persons upon seeing them shouted “kill him” he will attain heaven and thereafter, all of them attacked the informant and his friend without any provocation. It is alleged that one of the attackers hit the informant on his head with a rod and tried to attack him with a knife and another of them kicked him on his face and private parts. 5. It is submitted by the learned Additional Public Prosecutor that the informant/victim has supported the allegation in the FIR in his statement recorded by the police. 6. I have perused one medical document which indicates laceration and stitch. It is submitted that witnesses also implicated the petitioner. The accused persons are in custody since 06.11.2025 and investigation has progressed to some extent. 7.
In the given facts and circumstances, it is provided that the accused petitioners, named above, shall be released on bail of Rs.30,000/- each with one suitable surety of like amount each to the satisfaction of learned concerned court subject to the following conditions that the petitioners: (a) shall co-operate the remaining investigation. Page No.# 3/3 (b) Shall not hamper or tamper with the evidence. (c) Shall not harass or harm the informant and other witnesses. (d) shall not misuse the liberty to commit any illegal activity and they shall also not commit any act which is prejudicial to social and communal harmony. 8. Violation of any of the conditions entails cancellation of bail. 9. Accordingly, this bail application stands allowed and disposed of. 10. Return the case diary. JUDGE Comparing Assistant
