[2025:JHHC:26636] -1- IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 5045 of 2025 Vijay Deep Kumar Sahu, aged about 32 years, son of Raj Kumar Sahu, resident of Village-Hurda, P.S.- Bano, P.O.-Hurda, District-Simdega, Jharkhand. ..... … Petitioner Versus State of Jharkhand ..... … Opposite Party -------- CORAM : HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI ------ For the Petitioner : Mr. N.K. Jaiswal, Advocate. For the State : Mr. Subodh Kumar Dubey, A.P.P. ------ 03/ 02.09.2025 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State. 2. The petitioner is apprehending his arrest in connection with Jariyagarh P.S. Case No. 05 of 2025, registered for the offences under Sections 316(2), 318(2), 338, 336(3), 340(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Khunti. 3. Learned counsel appearing for the petitioner submits that the informant had purchased one Scorpio vehicle prior to the assembly election, but on being asked by him, this petitioner paid an advance amount of Rs. 5,80,000/- through online for the said vehicle to M/s Pratik Automobile from his account on 16.08.2024. He submits that the petitioner helped the informant in contest of the assembly election and subsequently, the false case has been lodged against the petitioner. He further submits that the vehicle in question has been mortgaged by informant with one Sonu Kumar Sahu and that is evident from the agreement which was found in the said Scorpio. He further submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-10 of the petition. 4. Learned A.P.P. appearing for the State has opposed the [2025:JHHC:26636] -2- prayer and submits that the allegations are there against the petitioner of mortgaging the vehicle of the informant to one Sonu Kumar Sahu. 5. Considering that the petitioner is said to transfer Rs. 5,80,000/- to M/s Pratik Automobile for purchase of the vehicle in question in the name of the informant and subsequently the FIR has been registered against the petitioner alleging that vehicle has been given to one Sonu Kumar Sahu, however, from the agreement, it transpires that informant has himself mortgaged the vehicle in question to one Sonu Kumar Sahu and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para- 10 of the petition, I am inclined to provide privilege of anticipatory bail to the petitioner. 6. Accordingly, the petitioner, named above, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Khunti, in connection with Jariyagarh P.S. Case No. 05 of 2025, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Amitesh/-
