JUSTICE PRAVEER BHATNAGAR Order 08/08/2025 1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No. 75/2025 registered at Police Station Kaithwara, District Deeg for the offences under Sections 191(2), 191(3), 190, 121(1), 132, 109(1) [2025:RJ-JP:30760] (2 of 3) [CRLMB-6457/2025] and 310(2) of BNS and Sections 3 of Public Property Damage Prevention Act. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. It is argued that the injuries sustained to injured Mahendra Singh, Head Constable at his head was found to be simple sharp in nature. The injury sustained to other constable Jagan Singh was found to be simple blunt in nature. Prima facie offence under Section 109 of BNS is not made out against the petitioners. The charge-sheet has already been submitted against the accused- petitioners and there are no criminal antecedents against the accused-petitioners. The accused-petitioners are in custody since 22.04.2025 and the trial of the case may take considerable time. therefore, these bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed these bail applications and submitted the factual report. The same is taken on record. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and looking to the fact that the accused-petitioners are in custody since 22.04.2025 and the trial of the case may take considerable time, there are no criminal antecedents against the accused-petitioners, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely: [2025:RJ-JP:30760] (3 of 3) [CRLMB-6457/2025] 1.
