The petitioners are apprehending their arrest in connection with Koderma PS Case No.79 of 2024, for offence registered under section 384, 385, 342/34 of IPC, pending in court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel for petitioners submits that there is dispute between informant and one Akash Mandal who has sent a boy and identified himself as Suraj Kumar has demanded the money. He submits that facts have already been disclosed in the FIR by informant and two persons namely, Suraj Kumar @ Suraj Sharma and Rohit Kumar have been granted regular bail by learned Sessions Judge, Koderma in B.P.No.133 of 2024. He submits that petitioners have got no criminal antecedent. 4. Learned State counsel opposes prayer and submits that even notice under section 35(3) of BNSS, 2023 has not been complied by the petitioners and in view of that anticipatory bail may kindly be rejected. 5. Considering that petitioners have got no criminal antecedent as disclosed in paragraph no.14 and notice has been issued to the petitioner under section 35(3) of BNSS, 2023 and in that view of the matter the petitioners, above named, are directed to surrender before the learned court concerned within two weeks from today and the learned court concerned shall release the petitioners on bail, on such terms and conditions and the sureties as the learned court may deem fit and proper.
