1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 119 of 2025 registered at Police Station – Baikunthpur, District- Koriya (C.G.) for the
2 offences punishable under Sections 111, 317(2), 317(4) and 317(5) of BNS, 2023.

The prosecution's case is that, from the portal of Ministry of Home Affairs it came to the knowledge that in the account number, which was belonging to the applicant, a sum of Rs. 11,48, 683/- was received and subsequently Rs. 11,19,128/- was withdrawn. Since in the account of applicant, the said amounts have been received and withdrawn due to a Cyber fraud, therefore, the applicant is also shown as an accused in the present crime in question. Hence this anticipatory bail application.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits that in the year 2023-24, one agent of Bank of Maharastra came in the house of the present applicant and allured him that the government has launched a new scheme and as per the said scheme, the unemployed person will be provided unemployed wages in their account and for that the account is required to be opened and for this reason, the applicant provided his Adhar Card to the agent of Bank of Maharastra but after elapse of many months, the applicant not received the pass book as well as ATM and thereafter, he came to the knowledge about the aforesaid Cyber fraud when the applicant was called by the police of Police Station Baikunthpur. He further submits that the applicant is a young person aged about 30 years of age and if he is not benefited from grant of anticipatory bail his entire career will be ruined.
4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the bail application of the present applicant.

5. I have heard learned counsel for the parties and perused the case diary.

Having heard learned counsel for the parties, having regard to the facts & circumstances of the case, particularly, considering the fact that prima facie the involvement of the applicant is shown in the offence in question as the account belonging to the applicant, a sum of Rs. 11,48, 683/- was received and subsequently Rs. 11,19,128/- was withdrawn and it is a case of Cyber fraud, therefore, allegation made against the present applicant appears to be of serious in nature, which needs to be investigated thoroughly / properly, in these circumstances, I am not inclined to entertain this anticipatory bail application at this stage. .
7. Accordingly, the anticipatory bail of the applicant – Mohd. Wasim Ansari involved in Crime No. 119 of 2025 registered at Police Station – Baikunthpur, District- Koriya (C.G.) for the offences punishable under Sections 111, 317(2), 317(4) and 317(5) of BNS, 2023 is rejected.
