Jyotsna Rewal Dua, Judge Gist of petitioner’s grievance pertaining to non- release of his medical reimbursement bills was noticed as under in order dated 13.08.2025, passed in this writ petition:- “Petitioner is aged 66 years. He is a pensioner under the respondent-State. Petitioner is suffering from Cardial Amyloid and is under treatment for the said disease. His grievance is that medical reimbursement bills submitted by him are not being released in time by the respondents. 1 Whether reporters of Local Papers may be allowed to see the judgment? Yes - 2 - Respondents No.2 and 3 in their reply have admitted the petitioner having retired from their department as Drawing Master on 31.03.2017. That at present, petitioner’s medical reimbursement bills amounting to Rs.12,06,685/- (as on 06.05.2024) were pending due to non-availability of budget. Learned counsel for the petitioner contended that petitioner’s treatment requires lot of expenditure and for want of timely sanction of medical reimbursement bills, he is suffering. It is well settled that reimbursement of medical bills within a reasonable time is a right of the government employee. Let the respondents defray their upto date liability towards the due and admissible medical reimbursement bills of the petitioner by the next date of hearing. List on 02.09.2025.” 2. Pursuant to above, learned Additional Advocate General has placed on record office instructions dated 06.09.2025 from the Director of School Education, Himachal Pradesh, inter alia, stating that all previously sanctioned and processed claims, totaling Rs.35,51,053/- which include up to date medical reimbursement bills submitted by the petitioner as on 07.09.2024 (Financial years 2022-23, 2023- 24 and 2024-25) have now been cleared. Office instructions dated 06.09.2025 have redressed petitioner’s grievance with respect to non-release of medical reimbursement bills as on 06.05.2024 raised in this writ petition. - 3 - 3. It will be appropriate to notice that in terms of office instructions, two medical reimbursement bills of the petitioner submitted subsequently i.e. on 16.05.2025, amounting to Rs.6,84,469/- and dated 28.07.2025 amounting to Rs. 3,62,158/- are as yet pending. Learned Additional Advocate General submits that these bills shall also be cleared on priority basis. 4. In view of office instructions dated 06.09.2025 and the submissions made by learned Additional Advocate General, nothing further survives for adjudication in this writ petition.
