1. Heard Mr. A. A. R. Karim the learned counsel for the applicants. 2. None has issued for the respondent Nos. 1, 2 and 3 in spite of due services on them, therefore, this Interlocutory Application is heard ex-parte against the said respondents. 3. This application under Section 115 of the Limitation Act, 1963 has been filed by the applicants praying for condoning the delay of 46 days in preferring the connected Intest Case.
4. The learned counsel for the applicant has submitted that the applicant could not approach this Court within the prescribed period of limitation for the reasons mentioned in paragraph no. 4 of the application for condonation of

5. I have gone through the said reasons. 6. This Court is of the considered opinion that reasons stated in paragraph no. 4 of the aforesaid application may be regarded as sufficient cause, which prevented the applicant in approaching this Court by filing the Intest Case within the prescribed period of limitation. 7. Hence, the delay of 46 days in approaching this Court in filing the connected Intest Case is hereby condoned. 8. The Registry is directed to register the Intest Case and list the same for admission after a week on a date to be fixed by the Registry. 9.
