Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 24-04-2025 1) Petitioner has filed this petition against the order passed by the Sub Divisional Officer (Revenue), Masturi in Revenue Case No. 5/ A-89(21)/ 2019-20 dated 06.03.2020 whereby the election petition filed by the petitioner for recounting of votes pertaining to the election held in the year 2020 for the post of Sarpach, Gram Panchayat- Matiya, Janpad Panchayat- Masturi was decided in favor of respondent No. 3. 2) Learned State counsel submits that the Panchayat Elections were conducted in the year 2020 and tenure of the O/o Sarpach, Gram Panchayat- Matiya, Janpad Panchayat- Masturi has come to an end in the year 2025 and fresh elections have already been held, thus, this petition has become infructuous. 3) Heard. 3 4) Taking into consideration the submission made hereinabove to the effect that tenure of the O/o Sarpach, Gram Panchayat- Matiya, Janpad Panchayat- Masturi has expired, therefore, in the opinion of this Court, nothing survives for adjudication. 5) Consequently, this petition stands dismissed.
