K JYOTHI PRASAD 4 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue a writ or order, orders or directions more particularly one in the nature of Writ of Mandamus declaring the action of the 4th to 10th respondents in not taking action against 11th to 14th respondents basing on 1st petitioner's complaints dt.07-11-2020 and 21-11-2020 and thereby provoking the 11th to 14th respondents to interfere into petitioners peaceful possession and enjoyment over their wet landed agriculture property to an extent of Ac.0.75 Cents and Ac.0.25 Cents situated in D. No.449-3 of Arumbaka of Cherukupalli Sub-District registered vide Registration Document Nos.520/2020 and 521/2020, dt.27-05-2020 of Amrataluru Sub-District Registration Office, Amrataluru in their names respectively as illegal, arbitrary, discriminative besides violative of the Arts.14 and 21 of the Constitution of India. b)consequently, direct the 4th to 10th respondents to initiate action against the 11th to 14th respondents basing on 1st petitioners complaints dt.07-11-2020 and 21-11-2020 to see to not to interfere into petitioners peaceful possession and enjoyment over their wet landed agriculture property to an extent of Ac.0.75 Cents and Ac.0.25 Cents situated in D. No.449-3 of Arumbaka of Cherukupalli Sub- District registered vide Registration Document Nos.520/2020 and 521/2020, dt.27-05-2020 of Amrataluru Sub-District Registration Office, Amrataluru in their names respectively in the light of the letter and spirit said stay orders dt.22-11-2019 in CRP No.3441 of 2019, undertaking affidavit dt.04-12-2019 of the 11th respondent filed in EP No.91 of 2014 in OS No.217 of 2010 pursuant to the order dt.22-11-2019 in CRP No.3441 of 2019 and interim order dt.30-12-2019 passed in CRP No.3432 of 2019 and also direct the respondents to act upon complaints dt.07-11- 2020 and 21-11-2020 of the 1st petitioner and pass....…” 5 2. Heard Sri Peeta Raman, learned Counsel for the petitioners and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioners would submit that police are not taking any action against the complaint made by them. 4. Learned Assistant Government Pleader would submit that in view of the interim order passed by this Court no further orders are required to passed in this matter. 5. For ready reference, the relevant portion of the interim order dated 09.12.2020, passed by this Court is extracted herein under: “In the meanwhile, there shall be a direction to the 7th respondent- Station House Officer of Cherukupalli Police Station, to provide police aid to the petitioners for harvesting the standing paddy crop in the disputed lands as per the written request already said to have been made by the petitioners.” 6. Considering the submissions made and in view of the interim order dated 09.12.2020, this writ petition is disposed of. However, the parties are at liberty to recourse their remedy before the appropriate forum according to law. There shall be no order as to costs.
