GUNESHWAR SHARMA Order 28.11.2025 [1] Present Mr. Ajmal Hussain, learned counsel along with Ms. Basei Roja Shahni, learned counsel for the petitioner and Mr. H. Samarjit, learned PP assisted by Mr. W. Niranjit, learned Dy. G.A. for the State respondent. [2] The petitioner is in custody in connection with FIR No. 5(07)2025 MAO P.S. U/S 20(b)(C)/29 of NDPS Act since from the date of arrest on 07.07.2025. [3] It is submitted that the petitioner is a bright student studying in Lilong Haoreibi College and he is appearing 5th Semester Examination to be started from 04.12.2025. [4] Mr. Ajmal Hussain, learned counsel for the petitioner, also submits that the petitioner is innocent and in the circumstances, the bail application has been preferred. However, considering the ensuing examination to be commenced from 04.12.2025, the petitioner may be released on interim bail so as to enable him to appear in the examination. [5] Mr. H. Samarjit, learned PP, submits that the petitioner is involved in transportation of commercial quantity of narcotics substance and there is likely of absconding in interim bail and in the bail application, the admit card for appearing in the 5th Semester Examination is not annexed. [6] Mr. Ajmal Hussain, learned counsel for the petitioner, refers to the additional affidavit dated 17.11.2025 filed by the petitioner showing proof of receipt of a sum of Rs. 1,600/- (Rupees one thousand six hundred) for appearing in the 5th Semester Examination and he is yet to receive admit card. [7] This Court has perused the materials on record. As per the FIR, the petitioner is allegedly involved in transportation of narcotics substance in commercial quantity. However, without looking into the merit of the matter and to enable the petitioner to appear in the 5th Semester Examination, the petitioner is released on interim bail for a period of 20 days from the date of release subject to the condition that the petitioner shall on personal bond of Rs. 50,000/- (Rupees fifty thousand) with two sureties (Government employee) each of like amount with the following conditions that: (i) The petitioner shall report to the O.C., Lilong P.S. (ii) The petitioner shall furnish personal bond of Rs. 50,000/- (Rupees Fifty Thousand) with two sureties (Govt. Employee) of the like amount. (iii) The petitioner shall co-operate with the investigation. (iv) The petitioner shall not tamper with the evidence or influence witnesses. (v) The petitioner shall not leave Manipur without permission of this Court. (vi) On breach of any of the aforesaid conditions, the respondent is entitled to take appropriate action against the petitioner in accordance with law. [8] On expiry of the 20 days period, the petitioner shall surrender before the Superintendent, Manipur Central Jail, Sajiwa and a copy of the same be furnished to this Court and to the Ld. Special Court, NDPS for information. [9] With this observation, MC(Bail Appln.) No. 8 of 2025 is disposed of. [10] List Bail Appln. No. 26 of 2025 on 18.12.2025.
