ORDER: The instant petition under Section 528 r/w 457 of BNSS has been filed, by the Petitioner, seeking relaxation of the condition that on execution of personal bond of Rs.25,00,000/- (Twenty-Five Lakhs) for release of vehicle vide orders dated 10.06.205 made in Crl.P.No.1401 of 2025 in Cr.No.105 of 2025, on the file of the Junior Civil Judge, Piduguralla. At the time of hearing, Sri G.V.S.Mehar Kumar, learned counsel for the
2. Petitioner would submit that, this matter is squarely covered by the Order passed by a Coordinate Bench of this Court in Nagarapu Guru Anjaneyulu vs. State of A.P and others in Crl.P.No.7035 of 2025, dated 09.07.2025, wherein, it was held as follows:
“5. Considering the
submissions of the learned counsel for the petitioner and the learned Assistant Public Prosecutor, this Court is inclined to modify the condition imposed in Crl.M.P.No.1403 of 2025. The petitioner is directed to furnish a personal bond for a sum of Rs.5 lakhs and also produce one surety for a like sum. The remaining conditions imposed by the learned Magistrate shall remain in force till the completion of the trial. Accordingly, the order stands modified. ” Ms.K.Priyanka Lakshmi, learned Additional Public Prosecutor fairly
3. conceded that it is a covered order. Hence, in view of the Order passed by a Coordinate Bench of this Court
4. in Crl.P.No.7035 of 2025, dated 09.07.2025, and taking into consideration of the
facts and circumstances of the case, this Court is inclined to modify the condition imposed in Crl.P.No.1401 of 2025 in Cr.No.105 of 2025, on the file of the Junior Civil Judge, Piduguralla. The petitioner is
directed to furnish a personal bond for a sum of Rs.5 lakhs and also produce one surety for a like
sum. The remaining conditions imposed by the learned Magistrate shall remain in force till the completion of the trial. Accordingly, the order stands modified.
5. Accordingly, the Criminal Petition is allowed. Pending applications, if shall stand closed. any.
