Order 17/07/2025
1. By means of filing instant civil writ petition under Article 226 of the Constitution of India, petitioner has impugned the order dated 19.06.2025 (Ann-1) passed by the Deputy Commissioner of Police (Headquarters), rejecting the candidature of petitioner being disqualified in the physical criteria (suffering from colour blindness) in terms of Standing Order No. 14/2019 and Point No. 7 (9) of the advertisement dated 04.12.2019.
2. At the outset, it is noteworthy that the medical examination of petitioner was got conducted by the Haribaksh Kanvatiya
[2025:RJ-JP:26772] (2 of 3) [CW-10583/2025] Government Hospital, Jaipur wherein he was found to have suffering from “temporary unfit due to partial defective colour vision”.
3. On filing appeal thereagainst, the medical examination of petitioner has again been made by the Board constituted at SMS Hospital, Jaipur on 13.06.2025, however, in this constituted Medical Board, petitioner is found suffering from colour blindness. Counsel for petitioner has not disputed the factum that petitioner is suffering from colour blindness and has not questioned the medical examination of petitioner and medical re-examination of petitioner. However, the contention of counsel for petitioner is that the colour blindness may not be treated as a disability to consider the candidature of petitioner for appointment on merits on the post of Constable pursuant to advertisement dated 04.12.2019.
4. This Court finds that the Standing Order No. 14/2019 so also in Clause 7(9) of the advertisement, colour blindness has been indicated as a rider for appointment on the post of Constable. The relevant point No.3 of Clause 7(9) of the advertisement is being reproduced as under:-
“

5. It is noteworthy that in the instant writ petition, the Standing
Order No. 14/2019 and the relevant point No.3 of Clause 7(9) of the advertisement reproduced hereinabove is not under challenge. Moreover, this Court finds that petitioner has knowingly and
[2025:RJ-JP:26772] (3 of 3) [CW-10583/2025] voluntarily with such conditions have participated in the recruitment process, hence, otherwise also petitioner is estopped by the Principle of Estoppel to question such criteria of medical measurements.
6. Having faced with the situation, counsel for petitioner, having instructions from the petitioner, does not press the writ petition.
7. Accordingly, the writ petition is dismissed as not press.
8. Stay application and other pending application(s), if any, stand disposed of.
