Reserved on 09.05.2025 Delivered on 14.05.2025 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 6560 of 2024 Applicant :- Radheshyam Opposite Party :- State of U.P. Counsel for Applicant :- Santosh Kumar Tiwari Counsel for Opposite Party :- G.A. Hon'ble Siddharth,J. Heard Sri S. K. Tewari, learned counsel for the applicant; learned AGA for State and perused the material on record. . The instant bail application has been filed on behalf of the applicant, Radheyshyam, with a prayer to release him on bail in Case Crime No.86 of 2023, under Sections 302/34 and 201 I.P.C, Police Station Khesraha, District Siddharth Nagar. First information report was lodged by village chaukidar against accused after dead body of a girl was recovered from the river. He stated that dead body of the girl recovered is of daughter of the applicant. Someone has cut her neck and tore her stomach and thrown it in a gunny bag in the river.
Learned counsel for the applicant submits that the applicant is father of the deceased and there is no reason why he will commit her murder and threw her body in the river. Applicant has been falsely implicated in this case when he was not named in the first information report. He is in jail since 23.04.2023. Learned AGA appearing for State has opposed the bail application and has submitted that the daughter of the applicant had affair with a boy (Anoop Kumar) who belonged to scheduled caste and she wanted to marry him. The applicant did not wanted his daughter to marry the boy to her choice and hence he hatched conspiracy with other co-accused and committed the murder of his daughter and threw her dead body in the river. The knife used in the alleged crime has been recovered on the pointing out of the co-accused. During investigation call details of the applicant and the co-accused have been collected from which it is proved that they were in contact. The statements of number of witnesses including Anoop Kumar, were recorded by the Investigating Officer. Anoop Kumar admitted that the deceased, daughter of the applicant, had affair with him and she wanted to marry him, which was not liked by the applicant hence he got her murdered. This Court after hearing the learned counsels for the parties does not finds any ground for enlarging the applicant on bail at this stage.
The bail application is accordingly rejected. The trial court is directed to conclude the trial against the applicant as expeditiously as possible as per section 346 B.N.S.S.
