The applicant who is in custody since 15.04.2025 has approached this Court for grant of regular bail in connection with N.D.P.S. Case No.42 of 2023 arising out of Saiko P.S. Case No.19 of 2023, registered for the offence under Sections 15(c)/ 25 of the NDPS Act, pending in the court of learned Special Judge, NDPS, Khunti. 2. It has been submitted by learned senior counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 3. Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by learned senior counsel for the applicant that 245.7 kgs doda has been recovered from a pickup van and this applicant has been roped in this case only on the basis that he is the registered owner of the said vehicle. It has been further submitted that the applicant has already sold the said van to Mr. Mahadev Pahan on 11.03.2023 but name in the owner book has not been changed. Further, he has no criminal antecedent and he has no connection with the alleged crime. On above basis prayer for bail has been made. 4. Learned Spl. P.P. has opposed the prayer for bail of the applicant. 5. Considering the fact that commercial quantity of narcotics has been recovered and this applicant is the registered owner of the said vehicle, I am not inclined to enlarge the applicant on bail, at this stage.
