The Court :- This is an application for grant of letters of administration by the sister of the deceased through her constituted attorney in respect of the estate left behind by the above named deceased without the Will annexed. The deceased namely Alba Claudette Elizabeth Noronha died intestate, unmarried and issueless at Kolkata leaving behind one brother and one sister as her surviving legal heirs. The mother of the deceased predeceased her. One of the brothers died unmarried and issueless after the death of the deceased while the surviving brother has consented to the grant. The sister Mary Dolores Catherine Umapathy has through her constituted attorney applied for the Letters of Administration. The estate of the deceased consists of movables being money in a bank account and savings account in post office beside assets in private company in the form of mutual fund situated within this jurisdiction. This Court in exercise of its jurisdiction under Clause 34 of the Letters Patent, 1865 is invited to grant letters of administration without the will
2 annexed under the provisions of Section 243 read with Sections 254 of the Succession Act, 1925. Considering the view of the department upon complete scrutiny, the application for grant of letters of administration is allowed by granting order in terms of prayer (a) of the petition subject to the administrator withdrawing only Rs. 1,50,000/- from A/c no. 33210006643 maintained with Standard Chartered Bank at Apeejay House, Block C, Ground Floor, 15, Park Street, Kolkata-700016 and Rs. 3,00,000/- from Savings Account No. 1057593, Post Office Park Street, Kolkata 700016 with further liberty to liquidate the entire money of Rs. 9,22,661.62/- lying in Mutual Fund Holding-Level 2 Standard Chartered Folio No. 10037380/55 on complying with other statutory requirements. Once the inventory and accounts in terms of the grant are filed, it will be open to the Administrator to apply for further directions of this Court in respect of the balance amount. The estate of the deceased in India shall be administered by the administrator in accordance with the prevailing laws of India. The petition for grant of letters of administration stands disposed of, accordingly.
