Verma, Additional Advocates General, with Mr. Ravi Chauhan, Deputy Advocate General, for State. ____________________________________________________ Sandeep Sharma, Judge (oral): Though having carefully perused order dated 26.07.2025 (Annexure P-4), passed by the competent authority in purported compliance of mandate contained in the judgment dated 05.06.2025, passed in CWP No.9209 of 2025, tilted Kusam Lata Vs. State of H.P. & Ors, whereby direction came to be issued to the respondents to consider and decide the representation filed by the petitioner in terms of the Transfer Policy, this Court sees no illegality and infirmity in the same and as such, no interference is called for, however, having taken note of the fact that after passing of order dated 26.07.2025 (Annexure P-4), some vacancy has fallen vacant, innocuous prayer made on behalf of the petitioner to permit him to make fresh 1Whether the reporters of the local papers may be allowed to see the judgment? 2 representation, praying therein for her adjustment at convenient station, on account of adverse family circumstances deserves to be allowed. 2. Consequently, in view of the above, this Court without going into the merits of the case, deems it fit to dispose of the present petition, reserving liberty to the petitioner to file fresh representation within a period of two days to the competent authority, enabling afore authority to decide the same expeditiously, preferably, within a period of ten days. Ordered accordingly. Needless to say, authority concerned while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders thereupon taking note of Transfer Policy, formulated by the Government of Himachal Pradesh, which certainly enables an employee to seek transfer on the ground of adverse family circumstances.
