WPA 12417 of 2017 With CAN 1 of 2025 Md. Gajlur Rahaman & Ors. v. State of West Bengal & Ors. Mr. Sudipta Dasgupta Mr. Sutirtha Nayek … for the petitioners. Mr. Prolay Bhattacharjee … for the respondent/UOI. In re: CAN 1 of 2025 The learned advocate Mr. Sudipta Dasgupta submits that the learned advocate-on-record, Mr. Sutirtha Nayek has been given the Vakalatnama by 51 petitioners out of 53. Upon hearing the learned advocate appearing for the petitioner and considering the averments made in the restoration application being CAN 1 of 2025, this Court is satisfied with the explanation given towards the absence of the learned advocate of the petitioner before the Court on 24th January, 2025 when the writ petition was dismissed for default. In view thereof, the order dated 24th January, 2025 is recalled and the writ petition is restored to its original file and number. The application being CAN 1 of 2025 is, accordingly, disposed of.
As regards the writ petitioner nos.10 and 44, the learned advocate-on-record submitted that the above- mentioned writ petitioners did not give Vakalatnama to represent their case, and as such, the writ petition being WPA 12416 of 2017 stands dismissed as not pressed against the writ petitioners nos.10 and 44. Next date be fixed on 30th April, 2025. (Ananya Bandyopadhyay, J.) 2
