1. By way of this petition, the petitioners have sought the following relief(s):-
“10.1 That, the Hon'ble Court may kindly be pleased to call entire record pertaining to passing of Impugned-
Order dated 26.10.2021 and 23.05.2022 passed by the respondent No.04 & 05, The Collector, (Nodal-Officer) Vishesh Kanishth Karamchari Chayan Board, District- Kanker and District-Sukuma (C.G.) Annexure-P/1. 10.2 That, the Hon'ble Court may kindly be pleased to pass an appropriate order by setting aside the Impugned-Order dated 26.10.2021 and 23.05.2022 passed by the respondent No.04 & 05, The Collector, (Nodal-Officer) Vishesh Kanishth Karamchari Chayan Board, District-Kanker and District-Sukuma (C.G.) Annexure-P/1. 10.3 Any other relief (s) which this Hon'ble Court may deem fit necessary may kindly be passed in the interest of justice.”

Learned counsel for the petitioners would submit that the petitioners are Grade-IV employees working on the post of Peon in the Office of Rural Engineering Service, Bastar Division. He would further submit that gradation list was prepared by respondent No. 2 and the petitioners are eligible for promoted to the post of Assistant Grade-III. He would also submit that representation has been made by the petitioners in this regard on 31.08.2021, but the same has not been considered by the authority concerned. He would contend that a direction may be issued to the concerned authority to decide the representation made by the petitioners.
3. On the other hand, learned counsel for the State would oppose. He would submit that the post of Assistant Grade-III would be filled up by 75% through direct recruitment and 25% by way of promotion. He would further submit that names of petitioner No. 2, Smt Kunti Naag, and petitioner No.
3 3, Smt Kusum Kashyap, were recommended by the Departmental Promotion Committee for promotion to the post of Assistant Grade-III.

Taking into consideration the submission made by the parties, the instant petition, at this juncture, is disposed of with a direction to the concerned authority to decide the representation made by the petitioners dated 31.08.2021, strictly in accordance with the law, preferably within a period of 90 days from the date of receipt of copy of this order.
5. With the aforesaid observation(s), and direction(s), the instant petition is hereby disposed of. Sd/-
