ORAL ORDER The present petition is filed seeking transfer of M.C.No. 82/2023 which is pending on the file of the Senior Civil Judge, Maddur to the Senior Civil Judge, Ramanagara.
2. The facts of the case are that the marriage of the petitioner and respondent had taken place on 03.03.2014 at Sri Dharmasthala Manjunathaswami Temple, Dakshina Kannada District and out of the wedlock they are blessed with the son on
12.01.2015. In view of the differences between the parties on 08.05.2022 the respondent/wife had made a complaint to the police about the harassment. The respondent has also given a complaint against the petitioner in the month of February 2023. Thereafter on 19.08.2023 the husband had filed a petition for divorce on the ground of cruelty i.e., M.C. No. 82/2023 and the wife-petitioner herein had filed a petition seeking maintenance at Ramanagara and also gave a complaint at Bidadi. It is the case of the wife that she has to take care of the son and it is

difficult for her to travel 55 Kms and as such sought for the transfer of the pending M.C from Maddur to Ramanagara.
3. Learned counsel appearing for the respondent /husband submits that the distance is only 55 kms and it is not difficult for the wife to travel. Further son is also aged about 10 years and there cannot any difficulty for her to travel.
4. Having heard the learned counsel on either side, perused the entire material on record. The wife is residing at Bidadi along with the child in a rented house and it is difficult for her to travel from Bidadi to Maddur on every date of hearing. Considering the inconvenience being caused to the petitioner, this Court deems it appropriate to pass the following:
ORDER i. The M.C.No.82/2023 pending on the file of the Senior Civil Judge Court, Maddur is withdrawn and transferred to the Senior Civil Judge Court, Ramanagara.

ii. The petitioner/wife shall co-operate with the trial and shall not seek unnecessary adjournments. iii. Accordingly, the Civil Petition is allowed. iv. All pending I.As., in the civil petition shall stand closed.
