Ahmed, learned counsel for the petitioners; Ms. G. Hazarika, learned Standing Counsel, Revenue Department for the respondent no. 1; and Mr. J. Handique, learned Junior Government Advocate, Assam for the respondent nos. 2 & 3. 2. The petitioners, twenty-five in nos., have joined together stating that they have a common cause of action and have projected that they are legal heirs of one Late Naimuddin Mondal, who along with his three brothers, was one of the recorded owners and was in possession of a parcel of land measuring 32 Bighas 3 Kathas 3 Lessas [32B-03K-03L], covered by Khatian nos. 72/66 & Dag nos. 78, 79 & 80, situate at Village – Hatipota Part – II, Bilasipara Revenue Circle, District – Dhubri, Assam [‘the subject-plot’, for short]. It is the further case of the petitioner that the subject-plot was recorded in the name of their predecessors vide an Order dated 04.12.2004 passed in Mutation Case no. 175[B]/2004- 2005. But the petitioners have come to learn that subsequently, the subject-plot has been shown as Government Khas land purportedly on the ground that there was non-payment of revenue. According to the petitioners, they failed to pay land revenue since 2013 for which Page No. 7/8 the subject-plot has been marked as Khas land. They have projected that their family is in possession of the subject-plot since 80-90 years. 3. Aggrieved by the conversion of the subject-plot into the Government Khas in the revenue records, the petitioners stated to have filed a representation on 24.09.2025 before the respondent no. 2, the receipt of which had also been acknowledged under seal and signature by the said office. Projecting that despite submission of the representations, the receipt of which was acknowledged on 26.09.2025, the respondent no. 2 has not given any consideration to the said representations till date, the writ petition has been preferred. 4. Mr. Handique, learned Junior Government Advocate appearing for the respondent nos. 2 & 3 has submitted that the issue raised by the writ petitioners can be looked into by the respondent no. 3 and the petitioners have submitted their representations before the respondent no. 2. He has further submitted that if the representations, stated to have been submitted by the petitioners are still pending, this writ petition can be disposed of with a direction to the respondent nos. 2 & 3 to consider and dispose of the same on merits within a reasonable period of time. 5. Mr. Ahmed, learned counsel for the petitioners has agreed to the said submission advanced by the learned State counsel. 6. In view of the nature of grievance raised by the petitioners and the broad consensus arrived at by the learned counsel for the parties in the afore-stated manner, this Court is of the considered view that instead of keeping this writ petition pending, the same can be disposed of with a direction to the respondent nos. 2 & 3 to take the representations [Annexure-6 (Series)], stated to have been filed by the petitioners before the respondent no. 2 and which were received by the office of the respondent no. 2 on 26.09.2025, on board and thereafter, to consider and dispose of the same on its own merits and in accordance with law after giving a personal hearing to the petitioners. It is accordingly ordered. It is noticed that the representations have been filed only before the respondent no. 2. If the respondent no. 2 reaches a view that the representations are to be disposed of by the respondent no. 3, then Page No. 8/8 the same shall be transmitted to the office of the respondent no. 3 by the respondent no. 2 so that the representations can be given due consideration by the respondent no. 3. It is further observed that after consideration of the representations, the concerned authority shall pass a speaking order as expeditiously as possible, preferably within a period of two months from the date of receipt of the certified copy of this order at the office of the respondent nos. 2 & 3 from the petitioners and the same is to be communicated to the petitioner forthwith thereafter. 7.
