Neutral Citation No. - 2025:AHC:31659-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 474 of 2025 Petitioner :- Abhishek Kumar Singh Respondent :- State of U.P. and 4 others Counsel for Petitioner :- Anand Mohan Pandey Counsel for Respondent :- Seema Agarwal (S.C.) Hon'ble Arun Bhansali,Chief Justice Hon'ble Kshitij Shailendra,J.
1. This petition, purportedly in the public interest, has been filed, inter alia, seeking to question the status of respondent no. 5 and alleging that by indulging in corruption he has amassed huge property and, therefor, action be initiated against him.
2. Perusal of record indicates that in the application filed under Right to Information Act, 2005, details were sought pertaining to appointment of respondent no. 5. Further the entire basis of the petition is a complaint made by one, Raman Singh, resident of District Banka, Bihar, which complaint is addressed to the Prime Minister. From where the said complaint has been accessed/obtained by the petitioner has also not been disclosed. Except for the complaint made, no material has been produced to prima facie satisfy the Court pertaining to the merits of the allegations made.
3. The allegations made, apparently, are speculative and underline grievance appears to be that the respondent no. 5 is occupying the post for a long time at the same place, which cannot be made subject matter of public interest petition.
4. Consequently, we do not find any reason to entertain the present PIL. The same is, therefore, dismissed. Order Date :- 5.3.2025 P.Sri./Pkb (Kshitij Shailendra, J) (Arun Bhansali, CJ) Digitally signed by :- PUNEET SRIVASTAVA High Court of Judicature at Allahabad
