(At Present Confined In District Jail Dholpur). ----Petitioners Versus State Of Rajasthan, Through PP [2025:RJ-JP:32277] (2 of 3) [CRLMB-8154/2025] ----Respondent For Petitioner(s) : Mr. Dushyant Jain, Adv. Mr. Munesh Bhardwaj, Adv. Mr. S.K. Gupta, Adv. for Mr. Rajneesh Gupta, Adv. For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 18/08/2025 1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.166/2025, registered at Police Station Kotwali Dholpur, District Dholpur, for the offence(s) under Sections 318(2), 336(3), 340(2) and 61(2)(a) of B.N.S. and Sections 66-D and 66-C of I.T. Act. 2. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. It is contended the petitioners namely Saurabh, Rambraj, Surendra Singh, Totaram and Krishna Kumar are in custody since 07.06.2025, 08.06.2025, 25.06.2025 respectively. It is also contended that the charge-sheet against the petitioners have already been produced and the petitioners did not cause any wrongful loss to the Government as on the alleged false and fake Silicosis report no compensation was processed. The alleged offences are exclusively triable by Magistrate. The prosecution has charge-sheeted 9 accused out of 112 accused and the proceedings against the rest of the accused are kept pending under Section 193(9) of BNSS. The witnesses list contains 22 witnesses and [2025:RJ-JP:32277] (3 of 3) [CRLMB-8154/2025] voluminous record, the trial of the case may take long time, there are no criminal antecedents against the petitioners, therefore, their bail applications of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of bail applications. It is contended that the petitioners along with other co-accused conspired to generate fake certificate of Silicosis in order to get the compensation from the Government, therefore, their bail applications may be dismissed. 4. Heard and perused the material available on the record. 5. Considering the long incarceration of the petitioners and the fact that the alleged offences are exclusively triable by Magistrate, trial of the case may take considerable time and without expressing anything on the merits of the case, this Court deems it proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused-petitioners namely, 1. Saurabh Son Of Sunheri, 2. Rambraj Son Of Ramnath,3. Surendra Singh S/o Babulal, 4. Totaram S/o Jaadau Singh and 5. Krishna Kumar @ Guddu S/o Lakhan Singh, in connection with FIR No.166/2025, registered at Police Station Kotwali Dholpur, District Dholpur, shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
