JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 5 22-03-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. The petitioner is apprehending his arrest in connection with Fulwariya P.S. Case No. 471 of 2022, registered for the offences punishable under Sections 413, 414 of the I.P.C. 3. As per the prosecution case, during vehicle checking by police four motorcycle riders were seeing police party tried to fled away in which one co-accused apprehended and disclosed that he along with other accused persons including the petitioner involved in theft of motorcycles. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case only on the basis of the disclosure statement of the co- Patna High Court CR. MISC. No.31409 of 2024(5) dt.22-03-2025 2/2 accused Amit Kumar. The petitioner has no concern with the co- accused except that he is the co-villager of the petitioner. There is no material against the petitioner. Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation of the present case. 5. Learned APP opposes the prayer for anticipatory bail of the petitioner. 6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Fulwariya P.S.
