This application has been filed under section 482 of the BNSS, 2023 praying for granting pre-arrest bail to the accused/petitioner in connection with Margherita Police
Page No.# 2/2 Station Case No. 127/2025 u/s 112/308(2) of BNS r/w section-3 of PDPP Act. Mr. N. Hasan, learned counsel for the applicant has submitted that the applicant though named in the FIR, is not involved in the offences alleged in the FIR. He further submitted that another named co-accused has been granted the privilege of pre-arrest bail on 19.11.2025 passed in A.B No. 2734/2025. Mr. K.K. Parasar, learned Addl. P.P for the State has objected to the prayer made by the applicant on the ground that allowing the petitioner the privilege of pre-arrest bail at this stage may hamper the investigation. We have perused the material available on record. In view of the order dated 19.11.2025 passed by this Court in A.B No. 2734/2025, this Court is inclined to grant the privilege of pre-arrest bail to the applicant. Accordingly, in the event of his arrest by the Arresting Authority, the accused applicant is directed to be released on furnishing a bail bond of Rs. 20,000/- with a surety of like nature to the satisfaction of the Investigating Officer in connection with Margherita P.S. Case No. 127/2025, subject to the conditions that:- (i) He shall appear before the Investigating Officer within a period of 10 (ten) days of passing of this order, (ii) He shall co-operate with the investigation and appear before the Investigating Officer as and when required, and (iii) He shall not try to tamper or hamper with the investigation in the instant case. In view of the aforesaid, this pre-arrest bail is disposed of as allowed. JUDGE Comparing Assistant
