By means of the present application under Section 528 BNSS, the applicant has sought for a suitable direction to the Additional Chief Judicial Magistrate, Prayagraj in Complaint Case No.1112 of 2022 (Chandresh Kumar Vs. Ramakant and others), Police Station- Sarai Innayat, District- Prayagraj, within time stipulated by this Court, which is pending before the aforesaid court 3. It is submitted by learned counsel for the applicant that applicant has filed application under Section 156(3) Cr.P.C. which was registered as a complaint case. Statement of complainant under Section 200 Cr.P.C. was recorded on 17.10.2022 and statement of the witnesses were also recorded under Section 202 Cr.P.C. on 25.08.2023 but after that no substantial progress has been made in the proceedings and thus, a direction may be issued to the concerned court to decide the aforesaid case within specific time frame. 4. In view of aforesaid, the Court concerned is directed to expedite the proceedings of the aforesaid case and after completing inquiry under Section 202 Cr.P.C. and to decide the matter on the point of summoning (under Section 203 / 204 Cr.P.C.) in accordance with law, as early as possible, preferably within a period of one year, from the date of production of copy of this order before the court concerned. 5.
