Thakuria, learned counsel for the petitioners. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State. The allegation against the petitioners is that they had cheated a person from Bhutan of Rs. 500,000/- on a promise of doubling the money within a short period. Thereafter, they stopped all communication with the said person. Charge sheet has not yet been submitted. It appears that the petitioners have already spent 60 days in custody, the statutory period of detention being 60 days and by the time he is actually released and granted bail today he would have crossed the statutory period by the time of his release. Accordingly, the prayer for bail is allowed. The petitioners shall be released on bail with a bail bond of Rs. 50,000/-(Rupees fifty thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Bajali, Pathsala in connection with the Pathsala PS Case No. 86/2025 under Section 3(5)/111(2) (b)/316(2)/318(3)/317(4)/319(2) of the BNS, 2023.
